Troy Deel gave Lisa Ferry sex while I lived with him and -- with my $65,000 in savings -- kept house and cared for our baby, under his roof.

Troy Deel gave me and our baby no money but a lot of violence.

I paid Troy Deel's legal bills, twice. Judge Arthur Vieregg told me to give $2,400 to Deel's attorney, Sandra Havrilak. Judge Jonathan Thacher, however, told me nothing. Without notice, Judge Jonathan Thacher swiped $7,862 in bail bond money to give to Deel's attorney, Sandra Havrilak. The $7,862 were never returned to my brother Chris (even though I appeared in court) because the Supreme Court of Virginia said Sandy should keep the money Jonny stole from my relative to give to her.

I couldn’t afford to post my own bond because what remained of the $65,000 in savings, after borrowing from it to care for Troy Deel, his house, and our baby while Troy Deel was having sex with Lisa Ferry, got used up to pay lawyers to protect me from all the barratrous judicial proceedings Troy Deel hired Sandra Havrilak to inflict upon me.

A deputy sheriff arrested me in my home because I stopped showing up in their courts after feeling sick and tired of all the judges doing nothing to stop Deel’s crazy lawyer, this Sandra Havrilak, considering it’s the law, in Virginia, that custody and visitation deliberations should “preserve the dignity and resources of family members” (Paragraph A in § 20-124.2). Hence, the bond posting and seizure.

Troy Deel never paid my legal fees.

Miss Lisa is raising my daughter.

And my brother can’t stand me.

While I was building that bond with my newborn, and living with my baby's father, Troy Deel, because I thought it would be nice for Troy to bond with his new daughter too, Miss Lisa Ferry was screwing him.

Speaking of bonds, Mrs. Deel with her husband, who benefits from a top secret government clearance (which didn't stop him from rigging our transcript--the changes to my court record are so glaring that they couldn't have been accidental nor free), blocked Brigitte's uncle, my brother Chris, from recovering his (bail) bond of seven thousand eight hundred sixty two dollars ($7862) then seized, and pocketed, the entire sum for their own personal use only after they watched him invest, and lose, another eight thousand dollars ($8000) in legal proceedings to recover his bond.

Chris Wyvell still waits to see his niece, again, and his bail money.

My brother last saw Brigitte on October 13, 2004. Our father had been cremated that morning. It was Brigitte’s 7th birthday. She was allowed thirty (30) minutes with her uncle because he had agreed to the terms and conditions of the visit demanded and dictated by her stepmother, Lisa Ferry Deel, and her father, Troy Deel: Chris should not speak my name, never mention me, nor refer to me in any way in the presence of Brigitte if he insisted on seeing his niece that day. They met at a McDonald’s in Ashburn. Chris Wyvell kept his promise.

Our father was dying, and the Deels were quietly scheming to take away from us control of the Trust he established for Brigitte. Mr. and Mrs. Deel had intervened to conceal from us the fact that our father was gravely ill and to cut us out of our father’s will. The estate of Donald Wyvell had been valued at seven hundred thousand dollars ($700,000). Chris and I never saw our inheritance money. And the Trust remains in the improper possession of the Deels.

We, my brother and I, still wait to recover the Trust our father had designated for his only grandchild. There was no marriage, and Troy Deel had never adopted Brigitte.

Speaking of adoptions, money-grubbing schemers and children-haters Lisa Ferry and then-boyfriend Troy Deel entered into an agreement with ex-girlfriend Carmen Shimer that terminated his parental rights to the son Deel and Shimer had together. Ferry and Deel had arranged for the adoption of baby Jeffrey by Shimer's new husband as a means of extinguishing child support obligations, financial and emotional.

While Miss Carmen Shimer was pregnant with Troy Deel’s baby, Miss Lisa Ferry was screwing him. Lisa Ferry and Troy Deel first met and began to date just four years after she had secretly given birth to a son in a catholic convent where she hid from her father for the duration of her own pregnancy. She was in her mid-twenties. In the convent, she terminated her parental rights by giving up the newborn for adoption as a means of extinguishing child support obligations, financial and emotional.

Baby-rejecting child-abductors Deel and girlfriend Ferry (ever-present at transfers, in litigation, and for Zuckerman) took me to court to have me incarcerated, to have me supervised, to have my Mother’s Day weekend eliminated, my summer vacations blocked, my visitation terminated (ask them about 9/11) and my brother robbed. Our newly-wedded Deels even took me to court to have my visits with my toddler confined and restricted to Fair Oaks Mall across the street from their marital home. By her fourth birthday, my little girl, the baby Deel urged me to abort, had endured four different dangerous and debilitating visitation schedules in less than three years. Custody changed three times. Con artists Lisa Ferry Deel and husband, in their litigious and paranoidal rampage, finally took Brigitte. I may one day recover my daughter, but I expect never to recover my one hundred thousand dollars ($100,000) which were wasted in those courtroom games that were instigated by these two cons, these two thieves.

Home invaders Ferry & Deel had also burglarized my condo and had taken from it the social security card, the birth certificate, and the passport belonging to my fourteen-month-old, a paternity paper signed by her father, and every picture I owned of me pregnant with Brigitte.

Jeffrey was eleven when his mother died prematurely. I often wonder who cared for him after his loss. I know Deel didn’t. I don’t have information on Ferry's son. Worse off? I doubt it. (The death of Jeffrey's mother is based on unconfirmed information.)

Please do not show up on Saturday. This is not the way to get back into Brigitte's life. If you embarish her on Saturday, this will further deminish any chance of ever being a part of her life. If you really want a chance with her you must start communicating with me and only me without hostility or anger. I will not allow you into her life unless you seek and continue for a sustained period of time certified physicological counseling and medication.

Furthermore, you are not allowed into Belmont. If I find you inside the gates I will have you arrested for tresspassing. These words should sound familiar as these are the last words you said to me the last time you saw Brigitte at your home July 4th weekend of 2004. You said to me "You and Brigitte are never allowed on my property ever again and if you do it will be tresspassing". You should remember this, I have. Up until that time I made every attempt to insure that Brigitte got to see you during your scheduled visitation. You were a no show on many occasions and several times I brought Brigitte to your home. I do not know what took place that holiday weekend during your visitation with Brigitte, but you must understand that Brigitte has never asked to come back to your home since that weekend. If she had, I would have brought her. Unless you take serious what I have said above your chances to have a normal relationship with Brigitte will not happen.

You have defamed and libeled my wife and I in public for several years now. Please stop. Do not send emails to Lisa's employer, my employer, my employers associates or anyone else connected to me or my wife. Any further defamation will cause me to take action. Please remove Lisa's name and my name from your blog. Your linkage to Shivani's Face Book must also be removed. Your public posting of Brigitte's picture without asking her did not sit well with her or her friends.

It is just like the emails from my abusive X who through lies and accusations of me abusing our son with the help of his unethical attorney got custody. Not making much money, I have been unable to fight. After taking custody, he and his wife abused and neglected my son. He was expelled from school, not fed, not clothed and did not receive medical care for his TS. Then they pressed not once but three times assault charges on this young man and refused to give me custody of which I have been fighting in the courts for. Now do to the confusion and hysteria and abuse in the courtroom, my son is with DFS just rotting away. I had medical appts scheduled, clarinet lessons, etc and live in the best school district and residence possible in Maryland. Sadly his dad is in Fairfax. I have never experienced such horrible [male chauvinism] ever. It is horrible. The GAL and others just poster and say anything they want to say about me and get away with it The judge never asks for authentication of their comments etc and argue and yell at me in front of my son! I am a respected member of the community and a teacher and my X abused me and now my son and the judge and others will not see it. It is truly a man's world in Virginia and almost like a police state too! It is incredible. My son has been destroyed. He was ready for a top college and now he has not had the chance to even attend HS the past few years. I am sick from this He and I love each other so much. The dad and attorney did PAS on him and made him believe the lies and tried to alienate him from me but our love was too strong. Even though they continue to say they do not want him they refuse to drop the custody fight even though it is destroying his only son.

Domestic Violence (DV) by Proxy: Why Terrorist Tactics Employed by Batterers Are Not "PAS":

As more and more abused women lose custody to batterers in family courts, they are wrongly embracing the very ideas that enabled their abusers to gain custody in the first place. False accusations of “parental alienation" are often used by batterers to gain custody and to defend against accusations of abuse.

Some unfortunate women after years of enduring domestic violence have lost custody to the batterers who abused them. In these cases, batterers have made good on their threat to attack their ex-partner in the place she is the most vulnerable—by taking her children away from her. After separation, these batterers continue to wage their campaign of manipulation and abuse by attempting to convince involved children that their mothers never loved them. Looking for a way to describe their batterers' behavior, some mothers have called what their batterer is doing "parental alienation syndrome."

In reality, what these women are describing from their ex-partners is better termed Domestic Violence by Proxy (DV by Proxy), a term first used by Alina Patterson, author of Health and Healing. DV by Proxy refers to a pattern of behavior [in] a parent with a history of using domestic violence or intimidation, [who] uses a child as a substitute when he no longer has access to his former partner. Calling this behavior “parental alienation” is not strong enough to convey the criminal pattern of terroristic behaviors employed by batterers.

When his victim leaves him, batterers often recognize that the most expedient way to continue to hurt his partner is to assert his legal rights to control her access to their children. By gaining control of the children, an abusive male now has a powerful tool which allows him to continue to stalk, harass and batter an ex-partner even when he has no direct access to her. Moreover, by emotionally torturing the child and severing the bond between children and their mother, he is able to hurt his intended victim -- the mother -- in a way she cannot resist.

DV by Proxy includes tactics such as: threats of harm to children if they display a positive bond to the mother, destroying favored possessions given by the mother, and emotional torture (for example, telling the child the mother hates them, wanted an abortion, and is not coming to get them because they are unloved).

DV by Proxy may also include coaching the child to make false allegations regarding their mother's behavior and harming or punishing the child for not complying. DV by Proxy perpetrators may also create fraudulent documents to defraud the court in order to prevent the mother from gaining custody. Whether or not the child is biologically related to them is irrelevant to perpetrators of DV by Proxy. The perpetrator's main motivation is to hurt his ex; whether or not his own child is harmed in the process is irrelevant to him.

This is very different from "parental alienation syndrome" as described by the late Richard A. Gardner. Dr. Gardner described PAS as an internal process by which a child aligns themselves with a preferred parent to protect themselves from the divorce conflict. “PAS” is conceptualized as a psychological process of identification with a parent who, according to the theory, encourages this identification at the expense of the other parent.

PAS inducing parents, according to Gardner, are often unconscious of what they are doing to encourage the identification. In contrast, perpetrators of DV by Proxy are very conscious of what they are doing. Controlling, coercive, illegal acts often done by abusive and controlling people, usually men, are not subtle, and do not encourage an identification with a parent. Criminal, fraudulent, coercive acts are visible and obvious. These behaviors encourage compliance by threats and fear. Behaviors involved in DV by Proxy are deliberate and often illegal. These behaviors include: battery, destruction of property, locking children in rooms to prevent them from calling parents, falsifying documents, along with other similar overt behaviors.

The most dangerous aspect of Gardner's PAS theory is that that the alienating parent's behavior is theorized to be so subtle as to be unobservable. In other words, the behaviors that are supposed to cause the alienation are assumed to be happening without any proof that they have actually occured. As many women have discovered this makes a charge of "alienation" almost impossible to defend against.

While Gardner's theories regarding PAS have been shown to be overly general and have not been supported by careful research, behaviors seen in DV by Proxy can be readily observed. Behaviors involved in DV by Proxy are deliberate and planned; many are illegal, and if the child is given the freedom to talk, will be described in great detail by the child.

If the child's formerly favorable view of the victimized parent changes when exposed to tactics like this over time then it is more likely a form of "Stockholm Syndrome" or traumatic attachment to the abuser, rather than the alignment with one parent and negative reaction to the other that Gardner described as "alienation".

Hello Mr. Albo.... I am writing you because I have had no reply from Mr. Marsden. Legislators must get a lot of emails. Never easy to read and then answer every bit of it. I know because I get a lot of emails too. Most of the people who write me are parents, most are mothers, a few fathers. The message, however, is always the same. I hear over and over again that *BIOC* isn't working. But I think Virginia legislators know this. I think if Virginia legislators were more diligent about reading and responding to mail from their constituents who are innocent, and honest, parents in difficult legal situations because *BIOC* isn't working, my own mailbox would see less of it. People find me because I blog on the issue...I am hoping you might be open to considering, and pushing for, a new approach. This new approach is discussed below in my email for Delegate David Marsden. It's called THE APPROXIMATION RULE.

Good morning.

We met last December outside House Room C in the General Assembly Building the day of Judicial Interviews. You asked me, “What do you want?” Before I could answer, however, you told me to put it on ONE piece of paper. I said to you that it was too late now to propose legislation (for the 2008 session). And you shrugged your shoulders. I had traveled to Richmond that day to join a small group of parents who share a concern about how child custody gets done in Virginia, and why it gets done that way. Some of us were standing in front of you that day in December, outside Room C. You might remember. I hope you remember.

At the very top of this email message for you, please see the legislation that I hope you still can and will consider, and deliver, to the 2009 session on behalf of the many, many parents in Virginia who know that *BIOC* isn’t working. Many, many reputable people in reputable places have been writing and speaking on “The Best Interest of the Child Standard”--specifically, on the need to replace it with “a better way” because it isn’t working.

The legislation I would like proposed is taken from page 178 of PRINCIPLES [FN1]. I read that The American Law Institute devoted 10 years to compiling the information contained in this study and this presentation of model codes and “restatements” [FN2].

Relevant Virginia officials, however, appear to be paying absolutely no attention to this wonderful work, and effort, by ALI. I had no answer from Delegate Teri Suit when last year I invited her to join me for “State of the Family 2007.” The University of Richmond / School of Law / National Center for Family Law was hosting in September, 2007, its first ever national family law symposium. Elizabeth Scott and Robert Emery presented. Both scholars spoke at sessions devoted to making the case for an “approximation” standard, devoted to making the case for doing away with the “best interest of the child” standard [FN3].

Although Professor Scott is no longer at the University of Virginia, Dr. Robert Emery is still there as professor of psychology and director of The Center for Children, Families, and the Law. You can find his personal, professional, and contact information on his UVA web pages [FN4].

I think the Virginia General Assembly would benefit from listening to Dr. Emery speak on the value of The Approximation Rule, especially if repealing *BIOC* is too scary for them [FN5]. My own calculations show that it is possible that at least 7000 Virginia children each year join the thousands upon thousands of children already caught in never-ending “abuse & custody” cases (high-conflict separations and divorces almost always contain histories of family abuse). NOT repealing *BIOC* is too scary for me. The number of Virginia children in foster care is fixed at about 7000, I believe. Good attention, after all, is given to the foster care “crisis” afflicting so many, and so why should we not think about giving some “good attention” to the custody “crisis” afflicting so many more?

The presumptive amount of custody time mentioned in 1(a) in the above proposed legislation can be easily satisfied with Utah’s Minimum Schedules for Parent-Time [FN 6]. My own research has confirmed that the Utah Minimum Schedules follow the recommendations of our most respected experts on age-appropriate and developmentally-appropriate residence and parent-time arrangements for children with parents who live apart. Mr. David Levy of CRC told me way back that the Utah schedules were actually designed by a female administrator with CRC. The schedules are not new in Utah.

Section 2.06, which is also mentioned in the above proposed legislation, is referring to parental agreements. PRINCIPLES, the complete volume, can be viewed on Westlaw and in most law libraries. I have found it convenient to own my own softbound copy, however. You may look at it, if you wish.

I think it might take up to 3 years to pass The Approximation Rule in Virginia, that is, if we begin to introduce the concept during the GA session coming up, in 2009.

There has simply been far too little organized activity and far too little organized focus on the very real Racket that *BIOC* has now become. The hidden victims? Children [FN7].

AMERICAN LAW INSTITUTE PUBLISHES PRINCIPLES OF THE LAW OF FAMILY DISSOLUTION

(Philadelphia) – The American Law Institute (ALI) has published its first comprehensive work in the field of family law: Principles of the Law of Family Dissolution: Analysis and Recommendations. With this innovative and groundbreaking new volume, the Institute completes more than a decade of work on the legal consequences of family dissolution, including those involving domestic partners. These Principles cover such vital issues as the allocation of custodial and decisionmaking responsibilities for children, child support, distribution of marital property, compensatory payments to former spouses, and the legal effect of agreements between the parties.

Responsive to the enormous changes in society that have taken place over a half century during which divorce rates climbed and the traditional roles of men and women were challenged, this innovative volume moves beyond the traditional formulations that were often framed in such general terms as to give nearly unbounded discretion to the decisionmakers charged with implementing them. The Principles provide family law with the conceptual clarification and improved adaptation to social needs that has long been the ALI’s hallmark. The work is described as "Principles" rather than "Restatement" because "Principles" is the better designation for a project that carefully explores and clarifies the fundamental assumptions—about the best interests of children, fairness to divorcing wives and husbands, and the legitimate economic claims of unmarried partners—upon which the legal rules must rest. Many of these Principles, nevertheless, restate and clarify present law, while others recommend directions for implementation by courts, legislatures, and other appropriate decisionmakers. MOTHERS are responsible for seven out of 10 international parental child abductions, an Australian study has found. And the most common reason for the abduction is flight from an abusive relationship.
The findings of the International Social Service Australia (ISS) report present a sharp contrast to the 1970s, when fathers were overwhelmingly the perpetrators of parental abductions.
The key findings of the paper, titled Learning From The Links Between Domestic Violence And International Parental Child Abduction, were released to The Sun-Herald ahead of the report's publication later this month.
The results revealed a huge cultural shift over the past three decades, ISS executive director Maria Brett said.
"In the 1970s, it was a different time and a different environment, and we saw a lot of unhappy men wanting more contact with their children resorting to abduction," she said.
"These days, there are more women in domestic violence cases abducting their children and taking them overseas."
In the 1970s, fathers were responsible for 80 out of 99 cases analysed in a previous study drawn on by the report. The mother was the abductor in 18 of those cases.
Yet in 1999 women made up 70 per cent of abductors in an analysis of 1080 applications under the 1980 Hague Convention, an international treaty set up to deal with child abductions.
Men comprised 29 per cent of abductors and the remaining 1 per cent included abductors of both sexes - grandparents or another relative.
In 78 per cent of cases, abducted children were younger than nine years old.

Mothers were not rescued from individually violent men by policemen, social workers, lawyers, or other family members. Judges did not rescue mothers from violent men either. On the contrary, the (large number of) domestically violent fathers, including those who kidnapped their children, were not imprisoned, fined, or custodially punished. Of the 12 percent of the mothers who kidnapped their children (Table Two), 80 percent were imprisoned, fined, or custodially punished ... Sixty-two percent of the fathers used violence to win custody. They physically battered, psychologically terrorized, and physically ejected mothers from their homes; they kidnapped, and, with the help of mother competitors, brainwashed children ...

[ United States Congress, 1997 ] SAFE HAVENS FOR CHILDREN ACT OF 1997 - FINDINGS. The bill.
(1) Family violence does not necessarily cease when family victims are legally separated by divorce or otherwise not sharing a household.
(2) According to a 1996 report by the American Psychological Association, custody and visitation disputes are more frequent when there is a history of domestic violence.
(3) Family violence often escalates following separation and divorce, and child custody and visitation arrangements become the new forum for the continuation of abuse.
(4) According to a 1996 report by the American Psychological Association, fathers who batter mothers are twice as likely [as non-violent men] to seek sole custody of their children. In these circumstances, if the abusive father loses custody he is more likely to continue the threats to the mother through other legal actions.
(5) Some perpetrators of violence use the children as pawns to control the abused party and to commit more violence during separation or divorce. In one study, 34 percent of women in shelters and callers to hotlines reported threats of kidnapping, 11 percent reported that the batterer had kidnapped the child for some period, and 21 percent reported that threats of kidnapping forced the victim to return to the batterer.
(6) Approximately 90 percent of children in homes in which their mothers are abused witness the abuse. Children who witness domestic violence may themselves become victims and exhibit more aggressive, antisocial, fearful, and inhibited behaviors. Such children display more anxiety, aggression and temperamental problems.
(7) Women and children are at an elevated risk of violence during the process of separation or divorce.
(8) Fifty to 70 percent of men who abuse their spouses or partners also abuse their children.
(9) Up to 75 percent of all domestic assaults reported to law enforcement agencies were inflicted after the separation of the couple.
(10) In one study of spousal homicide, over 1/2 of the male defendants were separated from their victims.
(11) Seventy-three percent of battered women seeking emergency medical services do so after separation ...

[ Silverman, 2001 ] AMERICAN PUBLIC HEALTH ASSOCIATION - THE IMPACT OF FAMILY COURTS ON BATTERED WOMEN AND THEIR CHILDREN IN CASES OF DISPUTED CHILD CUSTODY AND VISITATION: PRELIMINARY FINDINGS OF THE BATTERED MOTHERS’ TESTIMONY PROJECT. Family courts are frequently reported to promote the endangerment of battered mothers and their children through awarding child custody or unsupervised child visitation to batterers, even in cases involving batterers’ continuing abuse of the mother, and/or outstanding allegations of child abuse involving these men. Previous analyses of court records have documented biases against battered women by the Massachusetts Family and Probate Court in such cases. This systemic mistreatment of battered women and their children has received little attention relative to other DV issues, despite an expanding literature describing the risks to children from battering men. This presentation will review the goals and methodology of the Battered Mothers’ Testimony Project, a collaboration of public health researchers, battered women’s advocates and human rights workers to examine the impact of family court systems on the health, safety and well-being of battered women and their children in cases of disputed custody/visitation. Preliminary findings from semi-structured interviews with 50 battered mothers regarding (1) experiences of abuse against themselves and their children, both during the relationship and since separation; (2) whether and how the batterer has continued to intimidate/abuse her through family court litigation; (3) experiences with state actors of the family court system (e.g., judges, custody evaluators); and (4) other concerns regarding their treatment within the family court system (e.g., discrimination based on race, sexual orientation, and/or socioeconomic status) will be presented. [ Bancroft, 2009 ] CHILD CUSTODY JUSTICE. The tutorial. An abused woman can be vulnerable in family court if she comes in with unfounded expectations. Perhaps the most widespread myth is the belief that mothers are favored by courts in custody disputes, which stopped being true decades ago. It is true that for roughly the first half of the 1900's the "Tender Years Doctrine" was influential, and mothers had some advantage in gaining custody of young children. (Prior to about 1900, mothers had no rights regarding custody at all.) But in the 1970's the tide was turning back, for various reasons, and by the 1980's fathers were winning at least joint custody in a majority of the custody battles they undertook, and winning sole custody more often than mothers, a situation that remains today. The Washington Post has written about her and so has Fairfax Woman. Her name is Sharon Zarozny, her business divorce counseling and divorce coaching. I highly recommend that anyone wanting to leave a marriage in Northern Virginia call her before they call that attorney. She's going to try to keep you out of court or at least try to keep you safe if not going to court is not an option. (She is not for you if an all-out custody war is what you are craving.) She will warn you that many attorneys are "in it to win it."

"They don't have to care about what's left of your family," Ms. Zarozny told Amanda Long last August during an interview for First Person Singular. She's right. And it's a rare divorce lawyer who doesn't consider a monied, narcissistic professional a "good catch." I've seen family lawyers prostitute themselves and throw ethics to the wind to satisfy the narcissistic urges of a wealthy abuser (and how often are narcissistic urges "family-friendly?"). People like Sharon care. She's a good find. We mothers, especially, are lucky to have her. So don't let it happen, do your homework, get informed. Get "court smart."

The Darren Mack case shocked Nevada and the nation. Could anyone have predicted that this millionaire "Father of the Year" might allegedly attempt to murder Judge Charles Weller and brutally stab his wife, Charla, to death? (Mack is awaiting trial on the charges.) The answer is yes. Both of these tragedies were predictable and preventable.

Though many have stated there was no forewarning that Mack might be a "ticking time bomb" who could allegedly commit murder, the reality is there were many warning signs that were ignored. What huge red flag was missed in the Mack case? Domestic violence. This case has made national headlines, but it has been largely overlooked in the media that this is a domestic violence case. Failure to identify domestic violence in divorce cases is a critical nationwide problem in family courts that can endanger judges, the public's safety, and the abuser's partner and children. The shooting of Judge Weller shows this failure can be deadly. In order to prevent future tragedies, including attacks on the judiciary and others, policymakers should mandate the screening and identification of the well-known warning signs of abusers who pose a high risk for homicide.

The Mack case included many common warning signs of an abuser who poses a high risk to commit murder: access to guns; controlling behavior; his wife's expressed fear that he would kill her; and separation -- all of which are significant predictors of intimate partner murder, according to a 2003 study funded by the National Institute of Justice. Domestic violence murders are not typically crimes of sudden, unanticipated violence where an abuser "just snaps," but instead are often the culmination of a predictable pattern of escalating abuse and violence.

Darren Mack was accused of domestic violence by his wife. These charges shouldn't be surprising, as Mack's controlling behavior and abusive [litigation] tactics during his divorce clearly indicate his actions followed a pattern common to domestic violence perpetrators. This escalating abuse, particularly after separation, can lead to homicide.

The most dangerous period for the families of violent abusers (and others) is the time following separation. Research shows that separation is a powerful trigger for homicide among abusers, who become enraged at losing control over their partners and children. Domestic violence perpetrators can be extremely dangerous after separation/divorce, as they often increase their violence to re-establish their control and dominance. The majority of domestic violence murders occur after separation.

We are not suggesting that all separated abusers will commit murder. However, a careful assessment should be conducted to determine which individuals pose a higher risk for lethality. The Mack case clearly illustrates that a thorough investigation by trained family violence experts should be mandated whenever domestic violence allegations are raised during a divorce. These investigations must include emphatically validated protocols to assess homicide risk, specifically designed for use with domestic violence perpetrators. A legal strategist Mack hired stated that Mack displayed "no propensity" for domestic violence, because he passed psychological testing with "flying colors." However, psychological tests are ineffective in screening for domestic violence or partner homicide risk because domestic violence is not rooted in mental illness -- most abusers are not mentally ill, so they often do well on such tests, and appear normal. Identification of a pattern of controlling and coercive behavior is the most effective method of assessment for domestic violence (a profile Mack fit exactly).

As seen in the Mack case, domestic violence perpetrators can also pose a danger to judges. Abusers accustomed to firm control of their partners can become enraged that a judge is now in charge, and their loss of control of the situation can lead to attacking third parties, including judges. (Judge Weller, now recovering from multiple gunshot wounds, presided over Mack's divorce case). In June 2006, in another domestic violence/divorce case, Jeffrey Phillips was accused of making a death threat to "put a bullet" through the head of Judge Peter Hurd, who had issued a domestic violence order against Phillips.

Innocent bystanders, including children, are also at risk of homicide and can get caught in the cross-fire when the predictable warning signs of lethality in domestic violence perpetrators are ignored. John Allen Muhammad, charged in the 2002 Washington, D.C., sniper shooting case (a murder spree that left 10 people dead), had a history of domestic violence and divorce. The sniper boasted, "Your children are not safe, anywhere, anytime." Reports state that after threatening to kill his estranged wife, Muhammad traveled to Washington, D.C., to hunt her down, and unable to find her, began shooting people.

In a 2003 domestic violence case, after his wife filed for divorce, Tacoma Police Chief David Brame fulfilled numerous death threats by shooting and killing his wife in a shopping center parking lot, then killing himself. In another 2003 domestic violence murder/suicide case, William Hoffine, refusing to accept his divorce, ambushed, shot and killed his 14-year-old son in front of a grocery store as the boy jogged with his cross-country teammates.

Nevada U.S. Sen. Henry Reid has shown leadership in response to the Mack case by spearheading a federal bill to increase court security. However, much more needs to be done. To prevent future domestic violence-related tragedies, legislators should mandate the thorough investigation of domestic violence allegations in divorce cases as well as the identification of the common warning signs of violent abusers who present a higher homicide risk.

While many question how anyone could have predicted that Darren Mack might have committed murder, the answer lies in the words of Charla Mack: "He is out to get me and someday he will probably kill me." We need to start listening.

Richmond trial attorney Coleman Allen told a VCOG audience that he's practiced in both Virginia and West Virginia. He's seen good and bad judges in each state, and has concluded that both states' judicial selection processes (West Virginia elects; Virginia appoints) have merits and drawbacks.

The final panel of Access 2009 focused on judicial selection in Virginia. Moderated by George Mason University Counsel, and VCOG board member Tom Moncure, the panel looked at both the policy behind Virginia's current practice and the political reality of changing it.

Staunton delegate Chris Saxman said he liked the way Staunton area lawmakers are able to get a lot of citizen input about potential judge candidates at the trial level, though he admitted that at the appellate level, legislators are often asked to vote on people they have no personal knowledge of. He also noted that the likelihood of the General Assembly giving up its current power to interview and recommend candidates is next to nil.

Larry Roberts, currently counselor to Tim Kaine as DNC chair and previously counselor to Tim Kaine as governor, said he appreciated the power the governor has to fill certain appointments without legislative approval, but also said it wasn't be the time to put all judicial appointments into the governor's hands.

Fairfax County Clerk of Court John Frey discussed how bad judges can sometimes stay on the bench too long. He noted that an adjusted pension-accrual process may be a way to lure older lawyers with more court (and life) experience to the bench. Frey also complimented Staunton for soliciting citizen input, saying he wished there were more public input in his area of the state.

A Washington DC lawyer castigated the Arlington County Juvenile and Domestic Relations Court and its current chief judge, Esther Wiggins-Lyles, in front of the Judicial Subcommittees of the Virginia House and Senate Committees for Courts of Justice in Richmond last Thursday. Once each year, Judicial Subcommittees of the COJ meet jointly in the General Assembly Building for the purpose of conducting interviews of incumbent judges, and “unless anyone comes to complain,” Del. Albo has said, “the judges usually get re-appointed.” Delegate Dave Albo, as chairman of the House Committee for Courts of Justice, has indeed opened up the process of re-appointment to the public. So on December 17, in House Room C, an attorney from the District of Columbia named Roy Morris spoke to press for the recall of Arlington County J&DR Chief Judge Esther Wiggins-Lyles, citing the cases of Ariel King, Nancy Hey, Benita Washington and Naomi Parrish -- four mothers -- as illustrative of this judge’s poor practices, poor procedures and poor decisions.

Listen to the speech by Mr. Morris, who is calling Del. Albo, and Albo’s fellow committee members, and Judge George Varoutsos, and Varoutsos’s boss Esther Wiggins-Lyles, on the carpet, with, as your guide, the handout by Mr. Morris that begins “Arlington Juvenile & Domestic Relations Court…Reputation in DC area of violating children and mothers human rights with ex parte hearings, without legal representation, or due process for mother or child” and ends by introducing a list of actions, corrections and proposals for change that would encourage and even force, in J&DR appointments, a commitment to more “H.E.A.R.T.”

Unless she announces in the next 12 months plans to retire, Judge Esther Wiggins-Lyles passes before the COJ in December 2010 because her term expires in 2011. Virginia imposes no limit on how many terms its judges may serve but requires them to retire by age seventy.

The Virginia General Assemby has exclusive selection and reselection power over the state's judges, and this assembly is guided by nothing. The Virginia state legislature abandoned the Judicial Performance Evaluation Program in 2009 and never has established formal written judicial selection guidelines -- formal written judicial selection criterions do not exist in Virginia law.

It is my opinion APA member William Zuckerman, Ph.D., of 8987 Cotswold Drive, Burke, Virginia 22015, Tel 703.764.0700, did a very indecent thing when he complained to Fairfax Circuit Court Judge Arthur Vieregg he wanted several thousand dollars more in professional fees. “He does that all the time,” Michelle Eabon, Ph.D., of 11244 Waples Mill Road, Suite G-1, Fairfax, Virginia 22030, Tel 703.691.4204, told me. Attorney Michael Kevin Murphy, of 10560 Main Street, Penthouse 15, Fairfax, Virginia 22030, Tel 703.385.9330, concurred. The same judge who appointed Dr. Zuckerman in February 2000 to conduct a custody evaluation for my legal case approved in September 2000 the overcharge of $3800.00 demanded by the psychologist [in open court, from the witness stand, and on the record]. Dr. Zuckerman never warned me about a surcharge during an office visit or with a letter or in a phone call. The evaluation with home visits would cost $10,000.00 to $12,000.00 he explained in our first meeting. But Dr. Zuckerman collected $16,400.00+ for his involvement with my case. He never bothered to do home visits, and his recommendations almost killed
my two-year-old ...

Judge Arthur Vieregg would force me to fork over nearly $6600.oo to cover 40% of Zuckerman's forged fees. The father was ordered to pay the remaining 60% in counterfeit charges.

The APA Ethics Office dismissed my complaint about PhD William "Bill" Zuckerman's perverted billing practices and procedures. So it is easy for me to presume this crooked court appointee is still tricking mothers, and fathers, out of their money, even today.

Linda Marie Sacks, an Ormond Beach mother, arrived this morning at the City Island Courthouse in Daytona Beach for a scheduled hearing (Case 2004-30312 FMCI) asking for unsupervised visitations and total contact with her daughters, ages 13 and 15. But Volusia County Family Court Judge Shawn L. Briese declined to hold the hearing, which had been on the trial court schedule for six months, and demanded instead that Sacks submit to a deposition by the opposing counsel during the scheduled hearing time. Sacks filed for divorce in 2004 after her daughters began acting out sexually ... In April 2007 Judge Briese ruled that the child lied, gave the father sole physical custody of the daughters and placed the mother on supervised visitation. Custody Crisis: Why Moms Are Punished in Court

Talk to mothers, divorce lawyers, and child advocates and you'll hear tales of a family court system that's badly broken.

To an outsider, Linda Marie Sacks had the perfect life. Her husband was rich, and they lived in a huge home in Daytona Beach, FL, where she spent her days shuttling her girls to school and various activities. Linda Marie describes herself as a "squeaky clean soccer mom" who "lived my life for my children." Behind that façade, Linda Marie says she married a monster -- a man who verbally and emotionally attacked her for years and sexually abused their two young daughters.
When she finally left him and tried to take her girls with her, she encountered a new monster -- family court. Rather than protecting Linda Marie and her two young daughters from a sexual predator, a family court judge denied Linda Marie custody and put her daughters into the hands of their sexually abusive father.
Talk to mothers, divorce lawyers, and child advocates and you'll hear tales of a family court system that's badly broken. It's one that routinely punishes women for coming forward with allegations of abuse by denying them custody of their children. Instead of protecting children from abusers and predators, the court often gives sole custody to the abusive parent, say child advocates. Mothers who tell judges their children are being molested or beaten are accused of lying and are punished for trying to intervene. Some are thrown in jail for trying to keep their kids from seeing an abusive parent. Women, many of whom have few financial resources at their disposal, are often at the mercy of a court system that is not designed to handle domestic violence.
Linda Marie first suspected something was wrong in 2002 when she received a shocking phone call from a school administrator. Her 7-year-old daughter was acting out sexually, with knowledge beyond her years. A short time later, the Sunday school teacher reported overhearing Linda Marie's daughter saying, "I suck my dad's penis." She received more phone calls from school about her little girl using Barbie dolls to simulate oral sex with a boy in her class. "I was very concerned, these are alarming red flags," said Linda Marie.
She consulted family therapists who also expressed alarm and concern, but failed to report these claims to an abuse hotline. In one of the therapy sessions, the oldest daughter drew a picture that depicted her father as an erect penis on legs. Linda Marie says she once walked in on her husband wiping her daughters' vaginas in the bathroom before school, "because he told me he wanted them to be fresh." When Linda Marie confronted her husband, he ignored and dismissed the allegations.
After 11 years of marriage, Linda Marie filed for divorce in 2004. Armed with detailed documentation, she believed the judge would grant her sole custody of her two daughters for their protection. "I was sheltered. I didn't know I had stepped into a national crisis in the courts," said Linda Marie, who spent tens of thousands of dollars in a legal battle that ended in the loss of her parental rights. Linda Marie has only seen her children during supervised visits for a total of 54 hours over the past two and a half years. "I'm one of the lucky moms," she said, choking back tears. "Some bonds are severed forever. I'm thankful for my two hours a month."
Some mothers like Lorraine Tipton of Oconto Falls, WI, have served jail time as the result of contentious custody arraignments. In November, a judge sentenced Lorraine to 30 days behind bars because she didn't force her 11-year-old daughter to follow the court's order to live every other week with her abusive father. "She's terrified of going; she has night terrors and severe anxiety," said Lorraine.
Her ex, Craig Hensberger, was arrested three times for domestic violence and once for child abuse. His criminal record also includes two DUI arrests, one of which happened while driving with his daughter. The court ordered Hensberger into rehab and demanded "absolute sobriety," but his daughter claims he still drinks excessively when she visits.
Hensberger admitted in court that he still continues to drink, but the judge punished Lorraine instead for trying to protect her child. "My abuser is continuing his abuse of me and my daughter with the help of the court," said Lorraine, who spent three days locked up until her daughter made the heart-wrenching decision to return to her father's home so her mother could be released from jail. "He can't get to me physically. The only way he knows how to hurt me is to take my child away."
"What we are seeing amounts to a civil rights crisis," says attorney and legal writer Michael Lesher, who co-authored the book From Madness To Mutiny: Why Mothers Are Running from the Family Courts -- and What Can Be Done about It. Many judges and court-appointed guardians act above the law with apparent impunity, he argues.
"There's no hearing, no evidence, no notice -- they can take your child away from you," Lesher tells momlogic. If a mother raises concerns or openly discusses child abuse in court, she typically ends up being the one under investigation. "Mom is guilty until proven innocent," he says.
A family court judge with the Los Angeles Superior Court refused momlogic's request for an interview to respond to these allegations.
Unlike criminal court, family court does not rely on criminal investigators to gather evidence in an alleged child abuse case. Instead, the court appoints family advocates known as "guardian ad litem," or GAL, who are expected to investigate the abuse allegations and make their recommendation in the best interest of the child. GALs are sometimes licensed psychologists, social workers, or attorneys who are not necessarily trained in evaluating sexual abuse or domestic violence. They have the judge's ear, and their opinions can alter a child's future. There are no juries and there's no mandate for legal representation. In fact, most women end up representing themselves because they can't afford the attorney fees.
Most moms don't want to take the case to criminal court because they prefer to keep the matter private. Legal experts contend the evidence in sexual abuse cases isn't typically strong enough to hold up in criminal court to overcome the threshold of "beyond a reasonable doubt." While the bar is set much lower for proving evidence in family court, advocates argue Child Protective Services frequently doesn't want to get involved. "If there's a custody battle going on, CPS won't touch it," says Irene Weiser of the advocacy group StopFamilyViolence.org.
There's no doubt fathers play a critical role in a child's life, and in most cases, are equally loving and capable parents who deserve custody. However, studies find when a wife accuses her husband of abuse, more than half the time, she faces a counter-accusation of "parental alienation syndrome," or PAS. Although PAS is not a medically recognized disorder, divorce attorneys often successfully argue that it emerges when a parent brainwashes a child into thinking the other parent is the enemy.
The psychiatrist Richard Gardner, who first coined the phrase "parental alienation syndrome" in 1987, has written more than one hundred articles on the subject, but has offered no scientific data to support his theory. While it's not considered a certifiable medical condition, PAS is widely accepted in the legal community.
"Parental Alienation unequivocally, categorically exists, and it's a form of child abuse," says author and forensic consultant Dean Tong. While he believes more studies need to be done to validate PAS, "it does exist, anecdotally speaking," he says. As an expert witness, Tong has been called a "fathers' rights prostitute" for his work in court clashes. But he also testifies for mothers who are fighting to appeal unfavorable rulings. For Tong, it's about using forensics to find the truth. "I'm not here to protect guys who are guilty," he says.
In years past, mothers were typically considered the "protective parent" in custody decisions when courts relied on the "Tender Years Doctrine," which states that children under the age of 13 should live with their mothers. Recently, several courts have ruled that doctrine violated the Equal Protection Clause in the 14th amendment, and replaced it with the "Best Interests of the Children" doctrine. It's a huge victory for the increasingly powerful Fatherhood Movement that contends dads are systematically alienated from their children after a divorce.
Tong argues the current legal climate continues to put fathers on the receiving end of false allegations. "It's handcuffs first, speak later," said Tong, who experienced that firsthand. In 1985, Tong's ex-wife falsely accused him of sexually abusing his 3-year-old daughter. He spent time in jail and went through "a year of hell" trying to prove his innocence. While Tong was eventually cleared of any wrongdoing, he never regained custody of his kids, and remained under supervised visitation for years. Tong became a self-taught expert on the subject of family rights and abuse accusations. He has written three books, including Elusive Innocence: Survival Guide for the Falsely Accused."There's an assumption that maintaining a child's relationship with the father is a good idea -- even if the father is abusive," says Stop Family Violence's Weiser, who believes when the overburdened court system is unable to sort out a custody conflict, it relies on misogyny. She argues there are many judges, GALs, and evaluators who believe that women are inherently vindictive and will lie to get a leg up in a custody battle. "We see it over and over again in family court, where judges or professionals don't believe the violence is occurring," Weiser says.
"All we have is 'he said, she said.' Who's telling the truth? That's up to the judge," says Tong, who believes the justice system isn't working for either side. "The system is not doing a good job interviewing kids, we're still in the dark ages there," says Tong, who thinks there needs to be more formal education and training for the professionals, including judges who are hearing child custody cases.
According to the American Bar Association, child abuse allegations in custody disputes are rare -- occurring in only six percent of cases. The majority of those accusations are substantiated. In terms of false allegations, fathers are more likely than mothers to intentionally lie (21 percent, compared to 1.3 percent). In fact, abusive parents are more likely to seek sole custody than nonviolent ones, and are successful about 70 percent of the time.
After three years of litigation, Linda Marie Sacks says she was no match for her ex-husband's financial resources and powerful connections. "He was buying his way through the courtroom." Despite 10 calls into the abuse hotline by licensed professionals, Linda Marie's ex-husband still claimed she was making false allegations of abuse to alienate his children, and the judge believed him. Linda Marie was kicked out of her home and put on supervised visitation with her two daughters, who are now ages 10 and 12. "The judge legally kidnapped my daughters and won't give them back," she said.
In some extreme cases, a custody decision will be reversed, which is what happened to Joyce Murphy. The San Diego mother was charged with kidnapping after she took her daughter out of state, away from the girl's father, because she believed he was a child molester. The father, Henry Parson, accused Joyce of parental alienation and she lost custody. "Despite my pleas for protection to the police and the DA and the family court representatives, and even psychologists, Mr. Parson was able to convince them and the community at large that he was the victim, and I was just an angry, embittered, divorced woman," explained Joyce.
Six years later, Parson was caught in the act and pleaded guilty to six counts of child abuse, which included oral sex with a child, molestation, possessing child porn, and using a child to make porn. After Parson received a six-year prison sentence, Joyce told reporters that family court's only good decision in her case was granting her full permanent custody of her daughter after her ex-husband was jailed.
Lorraine, the Wisconsin mom who was jailed for protecting her daughter, knows her daughter's nightmare will continue for the rest of her childhood. "He's never going to stop, it's never going to end until she's 18." Linda Marie says she's putting every penny towards her legal efforts to win back custody of her daughters. "I will never stop fighting for my girls. I know one day justice will prevail."
Critics argue that not only is the family court system broken, it was never designed to deal with issues like child custody. The goal is to develop solutions that are in the best interest of the child. "Unfortunately when judges and guardians start thinking of themselves as super government, all sorts of abuses will occur," says attorney and author Lesher.
Activists are working towards making reforms through legislation. "The heartbreaking challenge is that there's not one quick fix," says Stop Family Violence's Weiser. "This is a war -- it's very ugly, it's bloody, and very bitter," concludes Tong.

In the somber spirit of the U.S. Suffragettes, the Argentine Mothers of the Disappeared, the Turkish Saturday Mothers, the German Rose Street Women, and most recently, the Liberian Women who stopped a civil war, we are gathering at the White House to ask our President to meet with our delegates and to help stop the systematic removal and oppression of our children by family court.

BILL MIMS BIG MISTAKE! Newest supreme court justice was never a judge; in state with no judicial selection criteria, appointments reflect 'popularity'

Those of us on the "GovernorsUpdate" mailing list last night received news of the appointment of Bill Mims to the Virginia Supreme Court, news of another "tremendously" bad choice.

In a brief statement (pasted below), Governor Bob McDonnell congratulates the former state legislator and interim attorney general "on yet another accomplishment in a life dedicated to serving the citizens of Virginia." This blogger, however, would like to clarify, especially for readers who may be contemplating a case in the Supreme Court of Virginia, that "the accomplished" Mr. Mims has never served the citizens of Virginia as a judge. He comes to the highest court in Virginia with no judicial experience, an event made possible by the fact that the Commonwealth of Virginia has never established formal written judicial selection criteria in a mostly blind judge-hiring process rigged up by the state legislature and sheltered from the citizenry. For example, the McCormick house notice of the Mims interview arrived in my e-mailbox on the morning (at 9:43 a.m. precisely) of the day of the Mims scheduled interview--judicial interviews are conducted in Richmond.

I live in McLean.

The senate clerk forwarded no "Notice of Judicial Interviews."

I've said it before, I'll say it again: Only fools should hope for high caliber judging in such a system.

While I was building that bond with my newborn, and living with my baby's father, Troy Deel, because I thought it would be nice for Troy to bond with his new daughter too, Miss Lisa Ferry was screwing him.

Speaking of bonds, Mrs. Deel with her husband, who benefits from a top secret government clearance (which didn't stop him from rigging our transcript--the changes to my court record are so glaring that they couldn't have been accidental nor free), blocked Brigitte's uncle, my brother Chris, from recovering his (bail) bond of seven thousand eight hundred sixty two dollars ($7862) then seized, and pocketed, the entire sum for their own personal use only after they watched him invest, and lose, another eight thousand dollars ($8000) in legal proceedings to recover his bond.

Chris Wyvell still waits to see his niece, again, and his bail money.

My brother last saw Brigitte on October 13, 2004. Our father had been cremated that morning. It was Brigitte’s 7th birthday. They met at a McDonald’s in Ashburn. Chris Wyvell kept his promise.

Our father was dying, and the Deels were quietly scheming to take away from us control of the Trust he established for Brigitte. Mr. and Mrs. Deel had intervened to conceal from us the fact that our father was gravely ill and to cut us out of our father’s will. The estate of Donald Wyvell had been valued at seven hundred thousand dollars ($700,000). Chris and I never saw our inheritance money. And the Trust remains in the improper possession of the Deels.

My evaluation was conducted by the late Dr. Benjamin Schutz. His estate has not turned over documents despite a court order. I have spoken with Dr. William Zuckerman. He has done follow up on many of Schutz's cases. He wanted $5,000 just to read the file that was never completed.

I spent $17,000 in 10 months of meetings. I was told it would cost another $25,000 to $30,000 to complete testing including $12,000 to take my child to UVA etc.

My ex hid my child from me; lied about jobs, insurance etc.; made false reports to the police about me; slandered me to my family and congregation; and continues to interfere with custody in every way. I needed the materials from the study to defend myself.

I can no longer afford representation. My lawyer wants $10,000 to continue.

This whole process has done nothing for the "welfare of the child."

Every motion, meeting, interview, study, and hearing has been designed to make more money for lawyers and consultants.

I want to do everything I can to help others in this situation.

Hi ... It might help you to meet other former clients of Ben Schutz. I've placed your comment in 'Not to Mothers Like Us' where it will be seen by a representative of the Supreme Court of Virginia. They monitor my blog closely and check that particular post regularly.

You need to be in Richmond this fall for Judicial Interviews. All mothers with cases that have stalled, spiraled out of control, and bumped up against the built-in corruption of our family justice system need to be in Richmond for 'Confront Your Judge'--even if the judges who are hurting them are not up for reappointment.

That's irrelevant.

We need for the OAG to intervene. The GA is our access to the OAG. But the legislature will not take us seriously until they see a large group of aggrieved mothers in House Room C.

They know there's a problem. And they know what the problem is. We won't really need to say much--except maybe 'cut the crap.'

Much power in numbers.

“Unregulated authority”

EXTRACT: Due to the great deference afforded to the custody trial judge, these particular judges enjoy a position of authority over decision-making unseen in other types of cases. As a result, family law cases are infrequently appealed and have an extremely low reversal rate at the appellate court level. Legal scholars Sylvia A. Law and Patricia Hennessey maintain that, by its very nature, the best interest standard vests a high degree of discretion in trial judges, who are “effectively unreviewable on appeal.” The best interest factors are open to interpretation and allow the trial judge the ability to weigh each factor in accordance with his or her own personal conscience. What one judge believes to be right or wrong under the circumstances is likely to be very different from what another judge or lawyer will find appropriate. Law and Hennessey suggest that this “unfettered discretion permits judges (usually older, white males) to incorporate their own personal history, experience and bias in adding content to the ‘best interest’ principles,” and, because the factors involve the subjective observations of the trial court judge, the reviewing court has no objective way to find error, absent flagrant abuse.

By "we" I mean the many fit, loving, non-offending mothers who are the victims of litigation abuse, and foul play, after leaving violent and controlling men. The abusive fathers of our children are gaining custody of them at an alarming rate in America today, WHEN CASES GO TO COURT. Too often court-connected, or court-appointed, psychologists can be blamed for this. They lie. They cheat. They are without conscience and offer themselves -- their testimony -- to the highest bidder. These are "You Pay I Say" specialists who could care less about how many lives they damage and destroy by exploiting parents in post-separation, child custody disputes that go to court.

In 2001, a judge told me that unless I could present the court with a "Treatment Plan," I could not exercise my 2 weeks of summer vacation visitation with my 5-year-old. I had been misdiagnosed by child custody evaluator William B. Zuckerman PhD, of Burke, Virginia, who successfully (and deceitfully) persuaded the court I was unstable, that a "Treatment Plan" was required. Long story short, I have not seen my daughter (who was given to her abusive father) in many years because of this impostor Zuckerman. Zuckerman collected more than $16,000.00 for contributing nothing more than a bunch of "junk science" to our legal case.

The friend who left my home yesterday is also a victim of Dr. Zuckerman. Her visits with her young daughter have been "supervised" for the last several years because Zuckerman had also maliciously labeled her with mental problems.

I know of a dozen mothers wrongfully "diagnosed" by this worthless defrauder, and swindler.

Psychologists and psychiatrists need to be removed from family courtrooms immediately; they cause more problems than they solve.

In one of your many videos (I'm still working on seeing each and every one of them), I heard how psychiatry has invaded, or is invading, every facet of our life. I know from personal experience that the field has created a very comfortable niche for itself in the family courtrooms of the Commonwealth of Virginia. There you can even find the video of Dr. Jeffrey Schaler's acceptance speech that discusses the use of mental health diagnoses as "weapons," and "tools" for control.

Dear Mr. Clementson ... With all due respect, when will some consideration be given to the number of "loved ones lost and lives shattered" by William B. Zuckerman, Ph.D. in Burke, Virginia?

After I received two more back-to-back calls recently from individuals he victimized, I contacted a local attorney to inquire about class action against him. Years ago, in 2002, I wrote the Office of the Attorney General of Virginia to say that Dr. Zuckerman was defective and dangerous and should not be consulted by judges and lawyers during child custody litigation. Mr. Howard Casway answered my letter. He directed me to the Virginia psychology board. I have filed complaint forms with the Virginia Board of Psychology, the American Psychological Association and even the U.S. Department of Health and Human Services Office for Civil Rights. I have tried a Warrant in Detinue in Fairfax County General District Court, a Tort claim in Fairfax County Circuit Court and even an appeal in the Supreme Court of Virginia. And do you know that all I am asking for is to see and copy my complete mental health file? Dr. Zuckerman has withheld those records from me since December of 2000 when I first began to request them, in writing always.

[ Specifically, Dr. Zuckerman is withholding the automated Caldwell “Interpretive Report” for the MCMI-3 and the automated Caldwell “Narrative Report” for the MMPI-2. ]

I owe him no money. So what exactly is the problem with this man?

Dr. Zuckerman's detention of my mental/medical health information has cost me eight (8) summer vacation visitations with my daughter. She was three-years-old (3) when we last vacationed together. She is now twelve (12).

Our court order wants Brigitte Veronique Deel to spend fourteen (14) consecutive days with her mother, each summer. But nobody with the power to help her do just that wants her to.

One therapist, a Dr. Stanton Samenow, refused to help me collect my records from Dr. Zuckerman; he was not interested in them, he said. Another therapist, a Dr. Joseph Novello, never replied to my letter which asked for his help in collecting my records from Dr. Zuckerman.

Doctors Samenow and Novello, like Dr. Zuckerman, are very well-known in the courts of Northern Virginia. How do they dare to treat citizens in this way.

Can you begin to imagine just how much money my family members and I have lost to their shenanigans, their charlatanry? Let me help you: approximately $80,000.00.

My lawyer even refused to file a motion to help me recover my records.

So, Mr. Clementson, what does our Commonwealth of Virginia gain, exactly, from putting fit, loving, non-offending parents like me through such an ordeal?

I was teaching pre-school (see photo attached -- a boy sits on my lap), a class of three-year-olds (3), when Muhammad and Malvo began their shooting spree. At the time, I was also in the midst of the difficulties I describe above. I was feeling doubly terrorized in 2002. Muhammad and Malvo were on the loose -- our students were even kept inside for recess to keep them safe from bullets -- and I had shared three (3) forty-eight-hour (48) weekends only with my four-year-old (4) in the entire summer of 2002, which had just ended when their shooting spree started. My daughter Brigitte and I were together for a total of six (6) days out of the entire summer of 2002.

I saw her in July of 2004 and not again since.

Dr. Zuckerman is wholly to blame for this current state of extreme maternal deprivation of five plus (5+) years’ duration for one Brigitte Veronique Deel.

Your Dr. Zuckerman is my own personal terrorist.

Because my personal terrorist is still on the loose, my life of terror did not end with the execution of John Allen Muhammad last Tuesday night.

Because not one soul, not even an OAG rep, with the power to properly deal with William B. Zuckerman cares to do so, the burden becomes mine to organize and initiate a proper class action lawsuit against this fraudster. I am, quite frankly, not feeling too terribly enthusiastic about it -- this is not because I believe such a suit is un-winnable, this is because that burden should be yours, not mine.

The OAG would not be wasting its time.

I can assure you that the number of Virginia citizens hurt by Zuckerman is near-equal to the number of Virginia citizens hurt by Muhammad. I read below of his sixteen (16) victims.

I caught up with our newly elected governor, Bob McDonnell (see photo attached -- the ponytail belongs to me), one summer at the Alexandria home of Chris Braunlich who was running for School Board At-Large at the time. The Braunlichs were hosting an Open House in their backyard. Mr. McDonnell was still our attorney general then. We discussed Dr. William B. Zuckerman. I handed Attorney General Robert McDonnell a copy of an excellent paper authored by UVA's Robert Emery (see photo attached -- look for the little girl with the sad face) about people like Zuckerman. A friend and fellow victim, Wei Wilson, was at my side. Mr. McDonnell's community outreach coordinator, Juanita Balenger, was at his side. Ms. Balenger took the Emery paper from Mr. McDonnell, and they both promised us a follow-up call. The month was August, the year 2007. Ms. Wilson and I were never contacted, by phone or otherwise.

You see, Mr. McDonnell, as delegate, had recently, and successfully, sponsored legislation that broadened the use of child custody evaluations/evaluators in disputed cases.

Not only is it time for child custody evaluator Dr. Zuckerman "to go," very serious consideration should be given, immediately, to an outright moratorium on child custody evaluations in Virginia.

Statement of Attorney General on Muhammad Execution

RICHMOND – Virginia Attorney General Bill Mims tonight released the following statement on the execution of John Allen Muhammad:

“Tonight, John Allen Muhammad was executed by the Commonwealth of Virginia for his role in a killing spree that shocked our nation. Families of Virginia were held hostage in their homes, fearing they would be the next victim of a sniper’s bullet. Muhammad was executed for the murder of Dean Meyers, who was shot and killed while fueling his car at a gas station in Manassas. Meyers was one of 10 people murdered, with six additional victims shot, across four states and Washington, D.C., during 47 days of terror by Muhammad and Lee Boyd Malvo. The murder of Meyers was the 12th in the string of 16 shootings. A jury convicted Muhammad of the premeditated capital murder of Meyers in the commission of an act of terrorism, and the premeditated capital murder of Meyers within three years of the premeditated murders of other persons. The jury sentenced him to death for those crimes.

“While nothing can bring back the loved ones lost and lives shattered, tonight justice was served to the fullest extent of the law. Muhammad’s acts seven years ago remain particularly vivid in our minds today.

“Muhammad’s death penalty was exhaustively reviewed and affirmed by the trial court, Virginia Supreme Court, U.S. District Court, U.S. Court of Appeals and U.S. Supreme Court, and the Governor has declined to intervene. Our thoughts and prayers remain with the surviving victims and their families and friends, and with the families and friends of the 10 innocent victims slain by Muhammad during the unprecedented time of terror in the fall of 2002.”

The United States Supreme Court last month was requested to intervene by a Petition for Writ of Certiorari in the matter of Ariana-Leilani, a little girl separated from a protective parent and forced to live with an abusive one, in an appeal from the Supreme Court of Virginia.*

Since June 2008, pro-se litigant Dr. Ariel King’s parental rights, including her right of contact with her now six-year-old daughter, were effectively terminated by a “final” “custody order” by the Juvenile and Domestic Relations (JDR) Court in Arlington, Virginia -- a court “not of record.” The JDR Court entered a series of orders making an appellate review, including a statutorily provided de novo review by the Circuit Court, inaccessible.**

There is no love deeper, more complete, and more vulnerable than the love that caring parents feel for their children. There is a bond so strong that it can be hard to tell exactly where the parent ends and the child begins, and the line is even harder to draw when our children are very young. Mothers have an additional bond from having carried their children inside of their bodies and having given birth to them, and more than half of mothers have experienced a deepened attachment through breast-feeding their babies. That life-giving and sustaining connection deserves the full support and admiration of communities and nations.

Children need protection from their abusive parents. In the realm of custody litigation which involves abuse, the abusive parent tends to be the father while the protective parent is usually the mother, because most perpetrators of domestic violence and of child sexual abuse are male. We don’t know that much about what happens to protective fathers, since their cases are much less common, but we know that protective mothers frequently encounter a system that is insensitive, ignorant about the dynamics of abuse, and biased against women. In this context, mothers sometimes find themselves being forbidden by the court from protecting their children from a violent, cruel, or sexually abusive father. And this outcome is a tragic one, for children and for their mothers.

On behalf of the hundreds of people across the continent who are currently working for family court justice, I want to communicate to you our caring and solidarity with the challenging road you have ahead of you, as you fight to keep your children safe in body and soul. I want to let you know how critically important we believe that project to be, and how much your children need you to stand up for their rights and their well-being. You deserve admiration, not criticism, for the courageous risks you are taking on their behalf, and for your determination that all of you should have the opportunity to live in freedom and kindness…

My journey in the Fairfax County Circuit Court began in the Spring of 2004 and continues to this day. CH2003-182004 for the curious, as I can only touch on a few details of the egregious miscarriage of justice in this post.

The Commissioner's Hearing in March 2004 was presided over by Steven Garver of Reston. The thrust of his subsequent report was to strain to make everything 50/50. He minimized my ex's lengthy massage parlor/prostitute/pornography habit, despite his testimonial admittance and documented social diseases, equating it on "fault" grounds as tantamount to my fibromyalgia, which he seemed to imply may have justified and provoked it. Apparently he missed the part in the transcript where the ex admitted his habit had begun well before I met him, porno at 13, prostitutes at 20, and was concealed in whole or in part for most of our 20 year marriage. Mr. Garver is still a Special Commissioner and a spouse behaving badly's best friend.

The next stop was the Equitable Distribution Trial, now retired Langhorne Keith presiding over a two day debacle and most of the post Final Decree hearings. He allowed, over my fervent opposition, the marital residence, with its multitude of hidden problems, to be sold without full disclosure at the top of the bubble real estate market, specifically ordering me to be gagged and evicted when it was shown. For my efforts on behalf of truthtelling, I was heavily sanctioned. The marital residence was subsequently foreclosed upon and Fairfax County's own property records indicate it was sold at an "invalid sales price."

Then came Jonathan Thacher, still on the bench, who rubberstamped most of Langhorne Keith's handiwork in February 2005, and accepted and charged me with a variety of questionable bills, some clearly fraudulent on their face, associated with the ex's sale of the marital residence.

About the same time, fed up with the antics of the ex and his new wife, noting his behavior got infinitely worse after he hooked up with her in the fall of 2002 , a "prize" just six weeks off her last affair with a married man (admitted under oath) when that happened, I brought two tort suits, L226331 and L226453, because of their distressing conduct - such activity as rerouting my mail, canceling my credit cards, and an IRS audit which resulted from the ex's claiming as "alimony" money he gave me in early 2002, when we were separated but trying to work things out, as his share of the running of the marital residence which he still frequented. The Pendente Lite Order was not entered until January 2003. Judge Arthur Vieregg, now retired, ordered a sanctions trial on my Motions for Judgments, and in his Letter Opinions called the ex's tax fraud "...not taken steps related to income tax returns..." and "...not filed the necessary tax forms...". You can read the Tax Court opinion which ultimately went against the ex to see how off base the Fairfax County Circuit Court judge was. In June of 2007, a hearing was held, motioned by the ex's attorney, Michael A. Ward of Fairfax, but intentionally not noticed to me so that I would not have knowledge of it until after the fact, seeking to get money from the joint escrow account from the sale of the marital residence for all these bogus judgments aforementioned against me. Judge Gaylord Finch presided and less than 30 days later, in violation of the court's own "default" judgment rules, $76,957.21 was released to my ex and his new wife and his attorney. I did not find out until November 2008.

Almost from the start, the ex has been non compliant with the Final Decree. The alimony payment was rarely on time. His work information changed twice. I found out about it, but not because he ever informed me - or the court - per the dictates of the Final Decree. The first time he wrote me a note, signed and dated, copy in the case file, saying he did not have to comply; the second time, it was because he lost his high level security clearance and good government job, in part over the tax fraud which Judge Vieregg had found so insignificant, and there has been no response to my letters, from the ex, or from his attorney, who drafted the Final Decree. For years. Fed up, I filed Motions for Contempt and Sanctions and Motions to Compel thinking that might prod compliance. Nada.

The motions were finally docketed per order of Judge Marcus Williams, to be heard on November 24, 2008, for a full day trial. That day, the judge was Leslie Alden [ whose term expires in 2012 ]. She was in and out in less than an hour, spent most of that time listening to Mr. Ward, never heard my Motions for Contempt and Sanctions and banned me from bringing any further ones.

In January 2009, after bombarding all the members of the court with my complaints, I received a letter from her allowing me to bring these motions in Motion for Order to Show Cause form. The documents were promptly filed against the ex, the new wife and Michael A. Ward. And then began the stall to hear them by Erica Everhart, Judge Alden's then law clerk. I would have to come on three separate Fridays, and would at best get part of thirty minutes. Portions would not be heard. Not necessary to be on Judge Alden's docket, although in her letter dated March 26, 2009, the judge specified they were to go to her and her alone. These particular type of motions require a judge's order, which to date, almost a year later, despite being promised but has not been forthcoming. Fed up with the run-around from Erica, I contacted the Chief Judge [ Dennis Smith ]. His July 7, 2009 response indicated a willingness to assign a particular judge and give me the entirety of a Friday motion day. I argued for the original full day trial on a day other than Friday, in line with how the original Motions for Contempt and Sanctions and Motions to Compel were scheduled. His response, a letter dated September 21, 2009, was a blow off where he went back on his word, claiming these were appellate matters, which they could not be, since they were just filed and never heard. Nonsense. I wrote back to him at the beginning of October and there has been no response to date. All of the court's ex parte communications, noting mine were not, have been placed in the file.

The ex's violations of the Final Decree continue, and shortly they will impact my rights to his retirement account, if he hasn't raided it like all the others already. You can't make this stuff up, and this is just a thumbnail tip of the iceberg rendition. The file is not sealed; read it for yourself. Because next time, if these judges are not stopped from running the court system as they please, it could be you. I am learning that my story is all too familiar. My divorce case was heard in Suffolk, Virginia (3 hours southeast of Fairfax). I have lived in Northern Virginia for a little over two years now, since my ex-husband threw me and our 20-month-old son at the time out of our home.

The father of my son pulled a knife on me and locked himself in the bathroom. He kept yelling that he wished he was dead and wished he had a gun. When I tried to leave with our son in my arms, he swung open the door and tried to pull our son from my arms into the bathroom with the knife. During the first hearing two years ago, I was awarded full custody and he got supervised visitation. He was also ordered to go to a psychiatrist for an evaluation, which he turned out to be diagnosed with Major Depression and Adjustment Disorder.

A guardian ad litem in Suffolk named Thomas Kirk Pretlow was assigned to the case at the request of my husband's attorney. My attorney objected, requesting the judge appoint his own, but the judge turned the request down. From that point on and for two years, this GAL was a nightmare for me. Mr. Pretlow never called me, interviewed me, or even called my son's daycare and doctor for interviews. Pretlow kept threatening me to "talk" to my husband or it would result in me losing custody. I replied to him (through email) that I had no problems talking to my husband, but only about our son. My husband wanted to talk to me everyday, and cried to the GAL whenever I didn't, citing that I was not communicating. To make matters worse, my husband assaulted my mom during a visitation drop off and was convicted in August 2008.

Guardian ad litem Thomas Kirk Pretlow told me that it was my fault for the assault, even though I wasn't even there. Mr. Pretlow always blamed me for my husband's outbursts. I reported this GAL to the Virginia Sate Bar in November 2008 and wrote a letter to the judge. By rule, they notify the attorney when a complaint is filed. I was hoping this would get Pretlow to remove himself from the case, make the judge remove him or at least make him do his job, but it did not.

Mr. Pretlow said that my son should stay with me, but during the final trial on August 31, 2009, he stood up and said that he "changed his mind."

Pretlow said that I needed to "mellow out" and I needed to have my son taken away from me to teach me a lesson and make me talk to my husband. (The judge had said earlier in the case that he would wait for the GAL's opinion before making a ruling on custody.)

Our parenting evaluator, the clinical psychologist Brian K. Wald of Virginia Beach, also changed his mind.

Dr. Brian Wald’s first report recommended that I keep physical custody, with my son not spending more than a week from me. Well, in February 2009, Dr. Wald was paid double by my husband to conduct a new evaluation and had already conducted a home visit before even calling me to tell me. In court, Wald admitted to being paid $6000 by my husband and $1000 for his appearance. PhD Brian K. Wald even lied about when he spoke to me.

I lost physical custody of my son to a man with mental illness and an arrest record. I would ask myself how or why this happened, but I know how, and only the good Lord knows why.

I believe that this is a temporary situation to allow me to reach out to others and share my story.

The light must be shone on Virginia’s deplorable family justice system as this is the only way there will truly be justice. With so many corrupt attorneys and judges and guardians ad litem and child custody evaluators out there, to try to remove them all on our own would take forever. So let’s bring our stories together and together let’s shed the light on the bigger issue: children being put in harm’s way, and losing precious years, because Virginia has a bad and dangerously biased judiciary. If you want to share your story, you have a pair of ears ready to listen. I plan to publish an editorial of the many stories out there that are all too familiar, and devastating.

The story behind the abrupt and murky departure of former Norfolk Circuit Judge Alfred M. Tripp from the bench may now be public. And it apparently involves in part providing false information on judicial selection questionnaires sent to the General Assembly.
Tripp departed from the Norfolk courthouse in October 2007 under circumstances that no one would discuss. It merely was announced that he had been barred from the premises.
He resigned his judgeship in February 2008.
No one was talking; reporters from both The Virginian-Pilot and Virginia Lawyers Weekly had trouble getting any info on just what was going on with Tripp.
In November, the Virginia State Bar suspended his law license for impairment reasons.
Here is what may be the rest of the story: This morning, the VSB issued a press release about Tripp. His license was revoked Oct. 20, a move to which he consented.
In the release, the bar said that “[i]n consenting to the revocation, Mr. Tripp acknowledged that he provided false information on judicial selection questionnaires provided to the General Assembly to support his application for a judgeship.”
No other information was provided by the VSB. Tripp was elected to a seat on the Norfolk General District Court in 2003; three years later, he was elevated to circuit judgeship by the General Assembly.

Update: On Nov. 6, the VSB posted the order in which Tripp consented to the revocation of his license. In the order, the committee chair noted that Tripp submitted several questionnaires to the General Assembly in which he answered “no” to question asking if he had ever been treated for any emotional or mental illness or condition. In fact, Tripp had received treatment from 1987 to 2006 for a number of issues, including Post Traumatic Stress Disorder, the order stated.

At the very least, Judicial Inquiry and Review complaints for the previous 8 year term of the Judge should be made public during all legislative re-appointment sessions. At the very minimum, the date and nature of the complaint by title should be mandatory for re-appointment to the bench. If the public can’t vote for their judges, they should be able to be informed about what issues are filed against that Judge.

I would also recommend that Virginia finally establish formal written judicial selection criteria and require mental health assessments, to include testing for personality disorders, of all judicial candidates to help guide you in those considerations.

I am a low income mother who lost custody of my child over 7 years ago. I have to admit that I had had problems with depression and made some bad decisions. Those decisions did not include substance abuse, child abuse or even negligence towards my child. I was and am a loving, devoted mother. Even in my depression I managed to get myself up 2 hours before she arose in order to get myself together and give her a great start to the day. I was a single mother going through a bad patch but I always made sure my child was safe and happy.

Our judge, in Gloucester, Virginia, took my child away (pre-natally) having never ordered a home study, a case worker, or anything that would have taken place if Child Protective services had removed my baby. All she did was tell me to get my act together and come back. I did in 6 months. Believe me, losing my child was a big wake up call and I did. Then the judge told me to prove I could keep it up. I did and even though; she told me I had done a good job, told me to keep up the good work, then gave my mother (a woman very angry at me for reasons related to my stepfather), full custody. They said that 2 years had gone by so my child mine as well stay at my mother's. The same mother and step father that almost drove me crazy. I do take responsibility for myself and I am not blaming my mother. I am only saying that I am from a very dysfunctional family and I am the only one who has gone for help. No one else feels the need to change, improve and they have my child.

Not being from Gloucester, I was not aware of this judge's reputation. I was not aware of the reputation of my mother's expensive attorney nor the guardian ad litem and the counselor's (with a masters in social work) reputation. All I knew was that the counselor whom I had never met, ever; he testified that I was mentally ill though I had doctors and other professionals saying I was perfectly fit to parent my child. I knew that my attorneys had taken my money, described all that they intended to do in court, but once in court, did nothing. It was very confusing.

After putting and ad in the paper for a support group I became aware of the reputations of all involved. Co workers, therapists, social workers and just about everyone I came in contact with had a story of someone they knew that had knowledge of the corruption of all the individuals I had against me.

It appears to be a racket between 4 individuals in Gloucester, including the judge, the attorney my mother could afford, the guardian ad litem (with her own private practice) and this grandiose counselor that does not have credentials to even receive insurance.

I was and still am ordered supervised visits to this counselor who again, testified against me having never met me. It has been almost 8 years and I can't even speak to my child over the phone. I have remained in Gloucester as to not abandon my child, though all my other loved ones are in Florida or Philadelphia. I went to therapy and still do go, without any court order but to prove I am sane and no threat to my child.

I just got out of court this month, trying to amend (again) but the judge did not budge. I call them "The Dream Team" and there is no justice if they are involved together. My mother's attorney can say any thing he wants to, hearsay, lies, with no proof and no basis and he is not stopped. I have never had an attorney that was willing to object or stand up to this group.

I spent my last dime on an unbiased professional Doctor to evaluate me for fitness as a parent, in Virginia Beach and they would not even allow him to complete his evaluation by meeting with my daughter. The Guardian Ad Litem told me BEFORE court that she had already made up her mind and did not need to hear from him.

I am broke and have to pay this so called councilor for visits with my child. I have met many other women that are in the same situation I am but some of them can't afford the visits therefore can't see their children at all. I can barely afford it and it is coming close to the point that I may not be able to either.

My child has hit 13 now, which is a tender age if all is well. She has gone from a bubbly, happy, funny and loving child, to a complete stranger to me. She lives with my mother and her husband, both in their 70's in poor health, living on 16 acres of isolated property. She does go to a private school in Williamsburg and is getting a good education, however she has very little contact with other kids. My mother is not able to take her places often and since age 6 (when she was taken form me), she has not really had any fun to speak of. It's rare. No pajama parties, or bowling, or movies, etc.

At this point she has become so brainwashed against me that I am not sure she even wants to be with me anymore. I will say she was 12 and still getting up in my lap to be cradled like a baby. She has just recently stopped.

All I asked for, (this last time around) was unsupervised visits. After all these years the judge said no and I knew she would. Everyone knew she would. My father and my brother told me constantly, "Save your money...You can't win."

I am sorry to carry on. I just wanted to support your cause. Many people in Gloucester have and are going through the same. This judge told me that I could not represent myself and to never come in her court room without an attorney again.

It is awful. It is a travesty. It has to stop. If anyone hears me and can give me a phone number or address, I would certainly be grateful. I have wanted to get a group together to try and make a difference but everyone I have met feels afraid to speak out. I am not afraid and I really long to help others. I could use some help myself but if it is too late for me then I still want to help others in any way I can.

These Two Divorcees Will Help You Out

...Through the founders’ experience and the input of others, the site tries to offer guidance on what steps to take with a divorce and some of the options that exist, both legally and emotionally.

"Ellen" was looking for a way to help others and provide the advice that she never received but, in hindsight, so desperately needed.

"Jane" needed a venue to vent her own frustrations and, eventually, turn a negative into a positive.

The two distant relatives grew up in Alexandria and essentially re-found each other this past spring amidst a difficult point in both of their lives: Mid-divorce for Jane and post-divorce for Ellen. They soon settled on a solution and went about developing a website for people in situations similar to their own.

The result of the collaboration was LousySpouse.com, a Wikipedia-like advice and information website which, though still a work in progress, is already having a positive impact on themselves and others.

"The title is kind of funny and a little bit harsh, but the real intent is healing and moving on and providing focus and clarity," Ellen said. "Those are all things that I don't necessarily think I had because I was discovering it as I went along."

After hashing out their project, Jane and Ellen — their nomes de plume on the site to avoid unforeseen future repercussions — turned to their friend Vanessa, a web designer based in the Atlanta area who they knew could help get their idea off of the ground.

"It's a tough thing to try to tackle relationships on a website," said Vanessa, who is still married. "They're not professional therapists, they're not giving professional advice, they're just giving their message of 'Get through this, you can do it, we're here for you.'"

The product has since become something of a cross between a blog and Wikipedia, the free online encyclopedia that is both user-generated and audited. Visitors can find open diary entries, tools to help keep things in perspective and a forum to commiserate with others.

The forum's anonymous nature allows contributors to "vent their own anger without getting themselves into trouble," Jane said, adding that she, Ellen and Vanessa continue to come up with new wrinkles and information to bolster the site.

"It's definitely put together more like a blog, but we want to have a lot of information there so we've got to pack it in as much as we can and still be very personal," Vanessa said. "When I was designing it, I wanted it to be a unisex thing for men and women because this happens to everybody."

Tuesday night in Georgetown, the founders held a launch party for friends and some area residents who have already benefited from LousySpouse.com.

Spreading by word of mouth and shot-in-the-dark Google queries, the site has gotten over 1,000 hits since launching at the end of July and already had an impact on those seeking some sort of solace or advice.

"The blogs are very helpful, just knowing that there are other people out there who are going through similar things and saying what they went through, how they dealt with it, how they're getting through it … because my process is still ongoing," said one party-goer from the District also in the middle of her own divorce.

The woman, who spoke on the condition of anonymity to keep with the site's general atmosphere, said that she'd "never seen anything like Lousy Spouse" and has already told her friends with spousal issues.

So far, the bulk of the contributions and interaction on the website has come from women, Jane said, but men have also sent emails and commented on their "lousy" situations.

"Lousy goes both ways, for sure, because I think we all have the same challenges," Ellen said.

After a costly and confusing divorce, Ellen is glad to provide a service that was never really available for her and would have been precious.

"If I could have scoped the problem, framed it and known what I was up against," handling her divorce would have gone much differently, Ellen said. "But when you're caught off guard, shocked … it was a knee-jerk reaction for me and I couldn't find the information that I needed."

"Divorce is like a death in the family and a lot of people don't know what to say," Jane said. "People think it's very awkward. It's a scary process."

Jane said that when the prospect of divorce became a reality, both of the founders' initial reaction was to go to the internet for information. They built the website, in part, for people like themselves because they were unable to find helpful, free resources.

While more traditional options exist — the Second Saturday seminars on separation and divorce put on at Alexandria's NoVa Community College campus by Brilliant Exits, a Falls Church divorce counseling group — LousySpouse.com's founders want their venture to become an easily accessible medium for an increasingly internet-oriented generation.

"I'm hoping it becomes a resource and, frankly, the emails I've gotten to this point … make my devastation almost worth it," Ellen said. "If we could make one person feel a little less alone, a little less freakish, less overwhelmed … that's what I want to happen."

Lorraine Nordlund, Brett Kassabian and Michael Devine tonight were chosen by a team of local politicians to face Courts of Justice panelists for a second round of interviews on Thursday, December 17, 2009, in Richmond. The three were from among thirteen candidates reviewed this evening by a contingent of Northern Virginia delegates and senators responsible for filling the vacancies created by the departure of three longtime members of the Fairfax County Circuit Court bench: Judge Michael McWeeny, Judge Stanley Klein and Judge Gaylord Finch.

Lorraine Nordlund currently sits on the Fairfax County General District Court. Substitute Judge Brett Kassabian is a former Commonwealth Attorney in Northern Virginia. Michael Devine has a law office in Fairfax; Mr. Devine is also a "frequent filing" substitute judge in our 19th judicial circuit.

From my place in the audience, I had been most impressed by candidates William Daly, Michael Cassidy and Lorraine Nordlund. I was sorry Daly and Cassidy did not make the cut, with Nordlund.

The thirteen candidates each vying for a spot on the Fairfax County Circuit Court bench had been "processed" in just a little over three hours and with no public input!

Several such "processors" are trial lawyers who practice in Northern Virginia and appear regularly before the very judges they appoint. For example, Scott Surovell, who was elected in 2009 to the Virginia House of Delegates and represents the 44th district in Fairfax, is a member of Surovell, Markle, Isaacs & Levy, PLC. And J. Chapman Petersen, who was elected in 2001 to the Virginia House of Delegates and represents the 37th district in Fairfax, is also a member of Surovell, Markle, Isaacs & Levy, PLC. Delegate and COJ Chairman Dave Albo has served the 42nd district in Fairfax since 1993. Mr. Albo is partnered with Substitute Judge David Oblon in one of Virginia's 50 largest law firms: Albo & Oblon, LLP.

I HELP PEOPLE THROUGH THE CHAOS of separation and divorce -- men, women, couples and families. My elevator speech is: When happily ever after stops working, call me. Sure, you can call an attorney, but you better be ready to fight if you do. Many, not all, attorneys are in it to win it. They don't have to care about what's left of your family.

I'm not pro-divorce. But people are so scared of it -- they think it's easier to keep getting beat up or live without love than admit to a failure. Me, I'm pro-figuring out what's best for you and your family. Maybe you need to find a therapist or a financial adviser or an attorney who isn't a barracuda. Or maybe you just want someone to listen who knows that bad marriages can happen to a good person.

I went through the divorce from hell. I'm still going through it. I have had 13 years of insight to know how the system works. First time I had to go to an attorney, it was terrifying. A criminal goes to an attorney. I didn't want to go to court -- before a judge. People tell me, "I don't want to get a divorce -- I just want to get unmarried. I want it over, but I don't want to go through all that stuff." Divorce is hard enough to go through. I don't think we should punish people by putting them through a grueling court experience and depleting their bank accounts. My divorce took 41/2 years. I spent $60,000. My ex: half a million. I remember turning to my attorney and saying, "When will this be over?" And he said, "When one of you runs out of money."

Starting this was the only way I could make sense of what I'd gone through. I'm not healed yet. When my daughters want to rent a romantic comedy, I don't want to watch. When I go to weddings of young couples, I think: I lost that fairy tale. But I still like men, don't get me wrong. At my daughter's freshmen orientation, all the students stood up and walked out. I looked around the room and saw all these couples holding hands, leaning on each other. I don't want to go it alone forever.

In Is the Economy Affecting Your Love Life?

I’ve worked with many clients who are struggling with Upscale Abuse. Smart, educated, beautiful, gifted women who are shocked to piece together the fact they are in an abusive marriage. Most don’t have the “victim” mentality and are mortified to find that yes, they are victims of domestic violence. These women succeed at most things, so it’s excruciatingly painful that they can’t make their marriage work. Often they are married to powerful, high earning men.

Many have given up promising careers at their spouse’s unrelenting urging. Compassionate moms, they do all they can to protect their children from the dad’s emotional and/or physical abuse. They create beautiful homes, become a super volunteer, and do whatever they can to “make their husband look good.” They are so busy they don’t see how their spouse is slowly, but surely, chipping away at their soul.

Then one day they wake up and realize they can no longer perpetuate the happily-ever-after myth. Perhaps their spouse has had an affair, cut them off financially, grabbed them by the throat, or their survival instincts tell them they better make a plan to get out before it’s too late.

When kids are involved, a new wrinkle is added. Many women stay to protect their children from time alone with an abusive parent. Others have extreme guilt at breaking up their family. What they don’t realize is that it is exposure to conflict, and witnessing abuse, that harms children not divorce or losing a privileged lifestyle. When a child sees a parent get hit, yelled at or criticized the child unknowingly experiences it as something happening to him/her. So if you are staying for the children, studies show you are doing them more harm than good.

U.N. Tackles Universal Problem for Women: Divorce

Women the world over lose out financially in divorce, say custodians of the U.N. treaty on women's rights. That's why they are reviewing what CEDAW says on the matter, with a new general recommendation expected next year.

UNITED NATIONS (WOMENSENEWS)--Guardians of the U.N.'s treaty on women's rights have begun to address one of the most daunting challenges for women the world over: financially surviving divorce.

Setting international standards on this issue strikes at the core of cultural identity and even into people's personal sense of self, says Marsha Freeman, who heads a nongovernmental organization that is working with the committee currently reviewing the treaty's position on divorce. And that, she says, is "the hardest place to make these changes."

Freeman, an expert on women's rights and equality in the family, is the director of International Women's Rights Action Watch, a human rights group based at the University of Minnesota Law School that promotes worldwide recognition of the tenets of the U.N. Convention on the Elimination of All Forms of Discrimination Against Women, or CEDAW. Her organization is supporting the CEDAW working group that is studying the issue of divorce and its economic consequences for women.

Freeman helped draft the statement given by Ruth Halperin-Kaddari, vice president of the U.N. committee overseeing implementation of CEDAW, during the most recent review session on CEDAW, which took place from July 20 through August 7 this summer. During the meeting the committee began airing current research and findings on the economic consequences of divorce on women.

While revising the treaty's criterion for divorce won't be easy, CEDAW overseers consider it necessary. That's because although women the world over lead vastly different lives, most of them invariably lose out financially in divorce.

States party reports, nongovernmental organizations and the U.N.'s own research has determined over the years that in many countries laws and customs do not support either women's accumulation of property during marriage or equal division of marital property upon divorce . . .

Laurel Eisner, executive director of the New York City nonprofit Sanctuary for Families, noted that in the United States women often opt for an uncontested divorce, giving up their claim to property, because it is quicker to file a no-contest divorce that seeks nothing but the dissolution of the marriage. Such women may want a quick exit because it can help free them from an abusive relationship or avoid a costly legal battle, Eisner told Women's eNews.

Women often don't know how to safeguard their rights, nor can they circumvent corruption that's built into the legal and judicial professions . . .

The parents I discuss here are narcissistically vulnerable and overwhelmed by pathological amounts of envy. In addition to serious issues such as religious training or geographical dislocation, they fight over minimal differences in visitation, overreact to real or imagined slights, and seem to ignore their children’s need for stable and secure relationships with both parents. They too wage intense battles over what might seem like insignificant issues. The parents who are the focus of this article seem blind to the effects their behavior has on their children and unable to think beyond their own emotional needs. I believe that parents who tear their children apart with interminable custody battles ward off psychic collapse by fighting for custody. Perverse modes of thought permit them to indulge their rage and aggression against the other parent and against the children who cause them so much despair. The perpetual turmoil of the child custody process permits these parents to hold out for the possibility of a perfect solution. They act as though there is a custody schedule that will be ‘just right’ for them and their children. However, I believe that these perpetual struggles serve to hold off hateful and murderous wishes directed against the other parent and against their own children. If hatred is a reversal of suffering, as Kernberg (1992) has suggested, then these parents remain both victim and victimizers in their own internal struggle.
...The psychoanalytic literature is surprisingly quiet on the subject of these kinds of conflicts. A search of the 34,000 references in the databases of the American Psychoanalytic Association for the words custody or high conflict in book or journal article titles yielded no results. Books and articles about divorce and custody that include psychoanalytic concepts mostly concern the effects of divorce on children. Most if not all of the literature on divorce has been written for lawyers, judges, parents, and nonpsychoanalytic therapists; it focuses primarily on how high-conflict divorce affects children and only describes the parents in broad strokes. Although narcissism, separation–individuation, dependent attachment, counter- and oscillating dependency, and unresolved attachment issues have been labeled as major factors in high-conflict divorces (…), these characteristics are rarely examined in any detail. Considering the pervasiveness of divorce in our society, the literature is quite limited in its scope. Where the literature has considered psychoanalytic concepts, narcissism and narcissistic vulnerabilities are referred to as the most common psychological struggle of parents engaged in high-conflict divorce…
...But as I hope to suggest, narcissism alone cannot always explain the intractable battles, financial devastation, self-destructive behaviors, or some parents’ willingness to psychologically harm and sometimes kill their own children. Although there are a number of dynamic variables that may contribute to high-conflict divorces, in this article I describe only those situations in which narcissism, pathological envy, disavowal, and perverse thinking all combine to create a mode of thinking and living that sustains some of these never-ending battles. The term high-conflict divorce, used to describe dramatic and chronic divorces, is too all inclusive. Within this category is a subgroup of parents whose behavior seems so obviously self-defeating and destructive to their children, yet they ignore this apparent reality. She participated in annual interviews last December, offered public testimony on being shellacked, slandered and shafted, in Virginia courtrooms and contributed to the removal of a state circuit judge. This fit, loving, non-offending mother would now like to offer some clarification, especially for those who did not go to Richmond on December 11 for Judicial Interviews of Incumbents and went instead to The Washington Post for the “scoop.” So below is her letter to the father of her child which does exactly that; it sets the record straight by properly implicating forensic psychologist and child custody evaluator William Zuckerman in the disposal of wayward jurist Gaylord Finch. Wei Wilson has not seen her 12-year-old, nor spoken with her, in more than two years. The victims of eight years of sham proceedings, agreements and judgments, they were for a second time wrongfully ordered into supervised visitation by yet another member of Fairfax’s Zuckerman-friendly bench, Judge R. Terrence Ney, in the spring of 2007.

Dr. Zuckerman is a quack -- a rainmaker's dream come true -- known to target good mothers of lone daughters and favor fathers with NPD and money.

Dear Ron,

Last fall, I accepted an invitation from Delegate and Courts of Justice Chairman Dave Albo to speak against the re-appointment of Judge Gaylord Finch. In December, with Ms. Elizabeth “Liz” Haring, I contributed to his removal from the bench. And in March, Tom Jackman of The Washington Post wrote about us. My name is missing from his article. So is the real reason why Judge Finch won’t be coming back in 2010.

I believe it is my turn to vacation with Grace this summer. I want to offer you one uninterrupted week and every other weekend, beginning on the day after school lets out and ending on the day before class resumes. Please write me with your answer by June 5.

If you are unable to agree it is my turn to vacation with Grace this summer, I am prepared to go back to court. (Our case is still open.) After all, I have nothing to lose by filing a motion, or two, or three, or four, whatever it takes to force the respect I don’t get and the fair rulings I am due. This, however, may not be true for the judges who hear them.

Next autumn will find me back in Richmond for “Judicial Interviews of Incumbents.” And whether or not I present testimony in 2009, or 2010, or 2011, or 2012, to the Courts of Justice panel will very much depend on when I finally see from a Fairfax judge the respect and the fair rulings I deserve.

Whereas, I have nothing to lose by going back to court, those judges going back to old attitudes about women in litigation when these women are mothers and old approaches to women in litigation when these women are mothers could face a new and unfriendly reality at interview time. Those judges clinging to old appointees and old “accessories” should count on it. For example, any judge more loyal to Dr. Zuckerman than to Virginia law would stand a good chance of being fired. Those judges have everything to lose.

It happened to Mr. Finch.

Missing from Mr. Jackman’s piece for The Post are my name and the fact that it was “Bill” who cut short the career of Judge Gaylord Finch; “Bill” is the real reason why Judge Gaylord Finch won’t be coming back in 2010. We have in our county worse judges than Finch. William “Bill” Zuckerman just happens to be the worst court appointee and the worst court accessory in our state. And these two are friends.

Mr. Zuckerman did not belong in our situation; he does not belong in our courthouse. Mr. Zuckerman belongs in our jailhouse, stripped of his license to practice psychology. And, because the reports and recommendations of this defective and dangerous “doctor” influenced all aspects of our case, all court orders in our case belong in the trash.

I hope the chief judge of our Zuckerman-friendly bench is still reading.

And I sincerely hope we will avoid litigation and instead begin to negotiate an agreement regarding our Grace, her summer vacations, and the importance of taking turns.

I have known Wei Wilson this year as a co-worker for the public school system. She has demonstrated exceptional skill working with middle school students with learning and behavioral deficits. She has a clear understanding of the emotional needs of young adolescents and has provided guidance and support to youth in her charge and to fellow staff. Her personal qualities as a parent are clearly in evidence. She is compassionate yet firm in instructing young people. She applies developmentally appropriate expectations of adolescent behavior. She is in exceptional health and vigor for her age. She demonstrates outstanding coping skills and ability to make positive decisions toward accomplishing her goals. She applies self-control and good work ethic in her very demanding job. She has successfully parented a son, who functions fully as a contributing citizen to society. I fail to see any reason why she should be denied the opportunity to parent her daughter. She seems emotionally and physically quite capable of doing so. In fact, it would be clearly detrimental to her daughter to continue any separation of mother and daughter. Daughters need their mothers. There are many problems that can result from denying a young girl the benefit of her own mother. The fact that she is of Chinese descent is an inadequate justification for doing so. Previous justification for separating this wonderful person from her child were based on misinformation and irresponsible conclusions. Having a birth mother parent her own daughter is, according to all current research, in the best interests of the child. To have allowed Wei [no] phone contact and only supervised visits is cruel and abusive to both child and mother. ...Wei, today's testimony was very telling. Samenow said Zuckerman found psychopathology in you, but he and multiple other professionals did not. What can we draw from that? Zuckerman lied about you, plain and simple. You lost your kid because of Zuckerman.
